Kentucky man arrested after throwing 1 lb of meth out of his pickup truck
Police officers spotted a pickup truck driving carelessly on I-75 South and tried to pull it over. As the truck began to slow down, officers noticed that the driver threw something out of the window. It appeared to be drugs.
London Police shared that they began giving the driver verbal commands to exit the vehicle, but he refused. Then a brief struggle ensued as officers arrested 30-year-old Deerick Rains.
According to Yahoo, officers found the package nearby, and it was 1.03 lbs of methamphetamine. They also discovered a large amount of currency, Fentanyl, and other items associated with trafficking narcotics.
Rains was charged with first-degree trafficking in a controlled substance with greater than two grams of methamphetamine, trafficking in a controlled substance (fentanyl), possession of drug paraphernalia, and third-degree possession of a controlled substance (an unspecified drug).
He also got charged with tampering with physical evidence and resisting arrest. There is an ongoing investigation into the incident and Rains was taken to the Laurel County Correctional Center.
If Rains didn’t throw the drugs out of his truck, he might still be free. Police officers can’t search a vehicle without probable cause unless they obtain a warrant and consent.
Probable cause involves seeing a weapon or drugs in plain sight or smelling the odor of alcohol or marijuana. So, if Rains didn’t have the items in plain view he may have gotten off easy with a traffic violation.
However, it’s unclear how he was driving or if he already had a warrant out for his arrest.
